Native Americans Working and Residing on Reservations not Obligated to Pay State Income Tax
Akwesasne Territory — Several community members received notices from the New York State Department of Taxation and Finance stating that they failed to file New York State income tax returns, owe state income tax and possibly owe fines for failure to pay the tax.
Mohawks who live and work on the reservation are not subject to New York State personal income tax. If you receive one of these notices, you should send the following:
1. A Certification letter obtained from the Tribal Clerk’s Office stating that you are a member of the St. Regis Mohawk Tribe.
2. A personal statement that you live and work in the territory, including your address and the name and address of your employer.
3. A copy of the notice you received from the New York State Department of Taxation and Finance, checking the box that says “Disagreement with Findings.”

Although we are not subject to New York State income taxes, these notices should not be ignored. Should these accounts go to enforcement, it becomes more difficult to address and could lead to garnishment of bank accounts and, in the case of casino/bingo palace employees, problems with gaming licenses. Please keep a copy of all correspondence with the state for your own records.
