Constable man shot down by Border Patrol

A Constable man is in stable condition at Burlington’s Fletcher Allen Health Care after he was shot by U.S. Border Patrol agents during an alleged drug-related incident in Constable.

Two agents have been placed on administrative leave pending investigation.

On Monday evening (May 5), border patrol agents said they attempted to stop two ATVs driving near the Trout River border crossing. The drivers of both ATVs allegedly fled into the woods. A short time later the agents spotted one of the ATVs again and when they approached it, they say the driver tried to run them down. As he was again fleeing, the agents shot at him.

It appears that the driver, Timothy Fleury, 25 of Bird Road, Constable, then drove to a residence on Route 122 and a 911 call was made for medical assistance.

Police say they have recovered three duffle bags filled with marijuana from the woods. The driver of the second vehicle is still at large and police have been scouring the woods since Monday.
